We will discuss the mediation process, the Collaboration process and the litigation process, explaining the strengths, weaknesses, opportunities and challenges of each approach so you and your spouse can make a mindful decision about how to proceed with the restructuring of your family. If you choose the Collaborative approach, we will discuss in detail how Collaboration differs from mediation and litigation. Unlike in mediation, you each have your own Collaborative attorney who will advocate for you as needed and will counsel you on what the law says and it doesn’t say. Unlike in litigation, the Collaborative attorneys promise to keep you out of the court not to go to court. They agree to help you decide for yourselves the best way to transition your family and to not leave those very personal decisions up to an impersonal judge. If you choose the Collaborative approach, we actually begin the Collaborative process during our complimentary consultation. Together we review the profiles, experience and credentials of Collaborative professionals and attorneys until you are able to choose which to engage for the Collaborative process.
